When a child is born out of wedlock, only the mother has custodial rights to him or her. Therefore, it is important for the biological father to act immediately to legitimate the child, for purposes of obtaining custodial and/or parenting time rights. In a similar vein, and although Georgia law entitles the child to support from both of his her parents, it behooves the mother to pursue a paternity establishment matter, such that child support can be calculated in accordance with Georgia’s Child Support Guidelines.
